Freehold sales and acquisitions

We act on behalf of banks or private lenders in connection with mortgages, guarantees, debentures and load agreements. We advise in connection with the acquisition and disposal of all types of commercial property including offices, shops, factories, licensed premises and farmland.

If you are considering selling or buying a property at auction you will need to have a lawyer present as the fall of the hammer constitutes an exchange of contracts. At this stage timescales are critical as parties become bound to the deal and we’ll act swiftly to conclude the transaction as efficiently as possible, ensuring your interests are protected throughout. We’ll ensure that We can also assist with sales or purchases at auction.

Leasehold property

We act for both Landlords and Tenants in connection with the grant, renewal or assignment of various forms of leasehold interests and on a wide range of terms. This also includes acting for a landlord granting consent to transfer of leasehold interest so you don’t get stuck with onerous repairing obligations. We are also able to deal with land registry and stamp duty and notification to HMRC to ensure all legal requirements are fulfilled.

We are also able to advise on lease variations which may include rectifying access problems, extending lease terms or remedying defective leases.

Lease extensions and enfranchisement

We are instructed by individual Landlords and Tenants and also corporate clients - particularly Management Companies - in connection with the extension of residential leases via either statutory or informal routes. This includes dealing with the initial serving of statutory notice through to claims which reach Leasehold Valuation tribunal.

We also advise and assist with the procedure for collective enfranchisement. This is where a number of leaseholders get together to purchase a freehold reversion. This gives leaseholders a greater degree of control and security over their investment. This may become imperative if the term of the lease is less than 70 years and may cause issues when selling or remortgaging property.

Residential lettings

The grant of residential leases or tenancies to include Assured Shorthold Tenancy Agreements. Short term agreements are generally accepted by the vast majority. These both give the tenant security and provide a process for the landlord to gain possession at the end of the term. Also including attending to the service of ancillary Notices in connection with a tenants occupation and also advising upon tenancy deposits.

Property Development, options and overage

We act for both large private or corporate organization on the acquisition and disposal of land for development and redevelopment. This could include the grant of options, most usually to developers, which may also incorporate overage provisions to ensure maximum profitability by claiming a share of profits upon the sale of land with potential for development.

The majority of Leaseholders who have already taken up a new lease have instructed Mrs Twiggs. For my part – acting for the Landlords/Freeholders - I have found it a pleasure to work with Mrs. Twiggs. She is thoroughly experienced in handling this matter and deals with all the paperwork I send to her in a professional and speedy manner.

Most importantly I have found that she is invariably available at the telephone and if that is not the case then she returns calls at the earliest opportunity.
